whether an employee killed was killed in the course of their work. The case went for appeal after being heard at a superior court and is interesting as this looks
at the issue of accidents by employees on company property who are using company equipment, but while they are off duty and not undertaking work tasks.
This case concerned Brett Milos who was employed by Quality Asphalt Paving. At about 10 pm one night Milos was driving a company ATV using it
to drive up a stockpile, when on the stock pile his head came into contract with an electrical cable and he was electrocuted and killed. At the time of the
accident Milos was not clocked on so was not officially working, furthermore colleagues at the workplace also testified that he had no authorisation to drive the ATV and had he
been performing his job it would have been a different vehicle that he drove, furthermore, had the supervisor seen him driving it he would have been stopped. The issue of
the status of Milos at the time of the accident is relevant for the way in which compensation for his death can be claimed.
The lower court decided that despite his status as not clocked in was not as important as the issue of the placement of the stock pile underneath the
power cable, which the court described as "unforgivable misconduct" and that placing a stock pile here created a foreseeable risk. The appeal was based on the status of Milos at
