that casinos and gambling is regulated in the US is complex, when looking at casinos these may be divided into two types, Indian and non Indian casinos; they are regulated
in different ways. Indian casinos are regulated under Federal Law with the Indian Gaming Regulatory Act. This apparent independence from State regulation is controversial, with the formation of this
independence from state regulation being seen in the case of called Bryan v. Itasca County, 426 U.S. 373, 96 S.Ct. 2102, 48 L.Ed.2d 710 (1976) where it was emphasized by
the Supreme court, that there was tribal independence from the state regulatory authorities. This was also supported by the case of California v Cabazon Band of Mission Indians 480 U.S.
202 (1987) where it was found that there was the ability of the tribes to operate gaming facilities without state regulation. This shows up one of the areas of controversy
as the primary source of regulation for gambling and casinos is within the state legislature (Washburn, 2008). States have argued for authority to regulate the Indian casinos, with arguments
that this would help to prevent problems such as the infiltration of organized crime. The need for regulation of Indian gaming started to arise in the 1970s and 1980s
when under the Regan administration there was increased pressure for Indian communities not become economically independent. The evolution of regulation has lead to the Indian Gaming Regulatory Act 1998 which
created the National Indian Gaming Commission, along with this there has been the creation of new federal offences that can be prosecuted by the U.S. Department of Justice and authority
has been delegated to the U.S. Department of the Interior. This is an act that has the aim of supporting economic independence, but also seeks to provide a legislative framework
