Repeated studies have shown that probation plays little role in effectively communicating with drug treatment programs to ensure that offenders are in fact utilizing these programs in accordance with their
probation. Because of this problem there is a higher rate of recidivism among those offenders sentenced to probation than are those who are incarcerated (Hevesi 1999). Findings based on
a study by the Office of the Comptroller in New York City showed that the percentage of recidivism was over sixty-seven percent of those placed on probation. This was
largely due to the fact that the probation officers do not follow through or enforce the drug treatment programs, resulting in a high rate of return to crime.
An additional problem in placing offenders on probation rather than incarceration is that of those who fail to attend the required drug treatment programs there is little or no action
taken; in other words, their probation is not revoked and these offenders get away with not attending. While this is not intended to fault the probation officers who no doubt
have too heavy a caseload to follow up on all offenders in their jurisdiction, it does serve to confirm the findings that probation is an ineffective method in discipline. Incarceration
is a more certain way to monitor the offenders and also serves to result in a higher rate of those who do not return to a life of crime after
their sentence is completed. Some facts that were presented to the Comptrollers Office in the City of New York showed that "drug offenders constitute the fastest growing segment of
