cases Dear John: An issue has come to my attention and I would like to relay the matter to the firm so that future real estate cases involving radon are not quickly dismissed or underrepresented. In fact, there is a tendency to ignore the problem and one case seems to be quite relevant to Pennsylvania law. As we accept real estate cases, radon is an issue that should be regarded as significant. Radon falls under various statutes, but case law demonstrates that realtors are responsible for omissions in this domain. Other cases have come forth regarding omissions, but radon can lead to potentially significant awards. Therefore, it is imperative that we treat Radon issues very seriously in light of the following case. Pete and Sue Ann Radakovich filed suit against three agents because they did not disclose the fact that a home contained a significant amount of radon gas (Abel, 1996). Charges against the agents include negligent misrepresentation and fraud (1996). Section ?1031. Nonliability of agent of the Real Estate Seller Disclosure Act reads: " An agent of a seller or a buyer shall not be liable for any violation of this act unless the agent had actual knowledge of a material defect which was not disclosed to the buyers or of any misrepresentation relating to a material defect" ("Real Estate," 2004). I am sure you are well familiar with this part of the law. It seems that in the case of radon gas, a costly result may ensue. In the case at hand a jury trial resulted in the order that two agents from Prudential Preferred Realty along with one agent from Howard Hanna Real Estate Company pay the Radakovichs $30,000 in total for their personal involvement in the transaction (Abel, 1996). ...
