to racial disparity in criminal sentencing standards. Such racial disparity no longer manifests itself in segregation and outright racism but it is still seen in the criminal justice system through
actions such as sentencing. Racial disparity and discrimination during the sentencing process can be found throughout the nation, and Winchester County in Virginia seems to illustrate the issue perfectly. The
cases of racial disparity for this county in Virginia are, on the whole, surprisingly high, with the court system handing down far harsher sentences to blacks than to whites. This
paper will attempt to provide a statistical overview of this situation. While the criminal justice system is designed to treat all men
equal no matter their creed, background, or race, racial inequality still occurs. Racial disparity is when one group is judged not only on their crime but on their race as
well. Such disparities cast a black mark on the criminal justice system and even though there are supposed to be safeguards against such occurrences such as an impartial jury, there
are still instances of racial disparities. This often results in accused criminals receiving drastically different sentences for similar crimes just because one man is black and the other white. While
such racial disparity often occur at many stages of the criminal justice system from arrest to sentencing and even to setting bonds and parole hearings it is the sentencing procedure
that often sees the strictest of discrepancies. Reports show that a white male born in 2001 has a 6% chance of being sent to jail while a black male born
the same year has a 32% chance (The Sentencing Project, 2010). This difference is drastic and dynamic and illustrates a serious issue.
