it regards the death penalty. After all, capital punishment has a finality to it that resonates with the people. They understand the seriousness of this punishment as well as the importance of the death penalty being applied fairly. In general, capital punishment appears to be necessary. Proponents of capital punishment usually cite the reasons for imposing the penalty as being retribution, deterrence and social control. Retribution may be thought of as the biblical "eye for an eye" mentality. Certainly, the punishment of death is similar to the crime as the convicted criminal has actually committed murder himself. Thus, death is a punishment that is similar to the crime committed and is congruent with the philosophy. And while proponents have good reasons for their support, opponents have legitimate reasons to be against it. They argue that juries are fallible and also take a humane approach. Even if someone did something despicable, it does not mean that the state has to stoop to the same level. Further, many civilized countries do not endorse the punishment. One important argument goes to fairness in terms of implementation. Even if one might conclude that the punishment in and of itself is fair, there is a sense that it is not administered fairly. Anecdotal evidence suggests that more black people are incarcerated than white people. The criminal justice system to a large extent is racially biased. Hence, one argument is that if the death penalty cannot be implemented fairly, it should be abolished. In the context of the criminal justice system, the death penalty is an extreme punishment.
