it is negligent or accidental, and the appropriate punishment. Discussion The facts of the case are as follows: a soldier coming off duty points his rifle into a clearing barrel
and pulls the trigger; the rifle fires. The questions are whether the discharge is accidental or negligent, and what the appropriate punishment is. The solider up to this point has
an exemplary record. A "clearing barrel" is a 55-gallon drum packed with sand, with a small hole in the side, where military personnel can place the muzzle of a weapon
and fire it, thus making sure that there is no ammunition left in the gun. The clearing barrel is a final check to make sure the weapon is empty; its
very unusual that a weapon fires in these circumstances, even though thats what its there for; the thinking is that the weapon will have been found to be empty before
it gets to this point. In this case, there was a round in the chamber and it went off. Because the gun was pointed into the barrel there was no
possibility of anyone being hurt (though everybody probably jumped a foot when it discharged). But is it a negligent discharge or an accidental one? Its been surprisingly difficult to find
solid reputable references about this issue. There are a great many "blogs" out there with people talking about the difference between an accidental discharge and a negligent one; the consensus
seems to be that an accidental discharge can only occur if the weapon somehow malfunctions and the soldier has no control over the firing. That means that accidental discharges are
