Bidders Edge is a company providing auction aggregation and then posting the results of its searches of online auction sites. Visitors to the companys site could find
items actively being offered at eBay and at other auction sites. The court found that Bidders Edge had interfered with and "damaged" eBays site - and therefore its place
of business. Bidders Edge was forced to cease gaining information about eBays site in that manner, but it was free to pursue another other approaches not directly prohibited in
the trial. 1. What did Bidders Edge do that was different than eBays normal customers? Why does it matter to eBay? eBay operates
solely online, of course, so all of its customers must visit its website and look at specific screens if they wish to gain any direct knowledge of any of the
items offered for sale by eBay at the time that Bidders Edge was collecting information about eBays offered items. There are several differences between a single retail customer and
Bidders Edge, however. The single normal eBay customer makes inquiries - demands - of eBays computer systems quite slowly and only one at
a time. Though thousands of individuals may be trying to access eBays system at the same time, they still operate at a speed much slower than eBays combination of
machinery and software. Bidders Edge, however, used "web bots" to search eBays site for items of interest to Bidders Edge. These web
bots enabled Bidders Edge to make between 80,000 to 100,000 information requests per day of eBays system (Singer, 2004). This level of activity may or may not have interfered
