Because of the war devastation in Kosovo, this immigrant decides to seek out and hire only programmers who are also refugees from Kosovo. Does this scenario violate the codes of
professional ethics? Clause 8.07 of the Software Engineering Code of Ethics and Professional Practices states that professional conduct requires that firms "Not give unfair treatment to anyone because of
any irrelevant prejudices" (1998). Section 1.4 of the ACM Code of Ethics and Professional Conduct (1997) states that Discrimination on the basis of race, sex, religion, age, disability, national
origin or other such factors is an explicit violation of ACM policy and will not be tolerated. A surface reading of both codes would suggest that the Kosovo immigrant is
behaving unethically. However, to ethically judge this situation, it is necessary to look beyond the statements in both ethical codes and examine the intent of these codes. In
both cases the intent is to make explicit a policy statement, which is that discrimination should not be tolerated, that is, individuals should not be treated in a derogatory manner
because of conditions beyond their control. The intent of these codes is to prevent negative action, and help rectify a social situation in which certain groups of people have suffered
from discriminatory practices in the past. The proposed hiring policy of the Kosovo immigrant is a positive action directed toward other immigrants. In the past, various immigrant groups
have come to this country. One of the ways that have allowed Jewish, Irish, Italian, German and Chinese immigrants to prosper is that all of these groups developed business centers
in various large metropolitan areas that catered to their own immigrant group. Having built up a strong financial base in this manner, these groups were then able to branch out
