has many problems confronting it in modern society. Three challenges, in particular, exist in todays criminal justice system. These are 1. overcrowded prisons, 2. high rates of recidivism,
and 3. how to deal with violent juvenile offenders. The number of prisoners, adult and juvenile, that are currently incarcerated in our nations jails and prisons is growing more
unmanageable by the day. The likelihood that these individuals will stay out of the prison system once they are released is, unfortunately, quite low. Recidivism is high.
The current response is obviously not working even for adult offenders. When particularly violent juveniles are introduced into the mix, the problems only grow more complex. The
intent of this paper is to discuss each if these challenges, the historical response that has been launched, the effectiveness of the current response, and to make suggestions for improvement.
Anderson (2009, 113) reports that in under four decades "inmate populations have increased tenfold, from under 200,000 in 1971 to over 2 million
in 2008." In 2004 just under 2.1 million offenders were incarcerated around the country (Whitford, 2004). Another 47.7 million were serving out parole terms or probation and another 15
