EXECUTIVE SUMMARY The circumstances surrounding the
war in Iraq have reverberated throughout the world. This affair is not always clear cut as to who is the perpetrator and who is the victim. The Abu
Ghraib prison scandal illustrates this fact perhaps as well as it can be illustrated. This prison facility houses Iraqi detainees. These detainees are guarded by U.S. Army personnel.
Evidence of prisoner abuse at the facility surfaced in January 2004 when a U.S. Army soldier, Sergeant Joseph Darby, provided photographic evidence of that abuse to his superiors.
As horrific as the problem was, it can be contended that a series of critical decisions spanning back well into U.S. policy and, indeed, to international law on terrorism.
Starting with the August 1, 2002 so-called "torture memo" regarding the interrogation techniques that were considered appropriate for al Queda and Taliban detainees at the Guantanamo Bay Prison Camp our
government began to explore the complex issues of terrorism. This paper explores several key events can be regarded as causative factors in the abuse at Abu Ghraib. Although
attempts have been made to blame this abuse on "low-level personnel" at the facility rather than facility policies, many have contended that this abuse is in fact directly traceable to
