Utah, there is now an anti-polygamy statute in place outlawing the practice. This paper takes the form of an internal legal memo that considers the situation and the arguments that
might be made for and against allowing a polygamous marriage to go forward. Statement of Issues Presented The question here is this: Can three consenting adults, two women
and one man, be legally married in the State of Utah, so that they can co-habit? (In other words, can a polygamous marriage go forward?) Answer to the Issue
The short answer would appear to be "no." While the First Amendment to the Constitution provides for religious freedom, the State of Utah ruled that its anti-bigamy statute
is not unconstitutional. Furthermore, the Church of Jesus Christ of Latter Day Saints (Mormons) long ago banned the practice of polygamy. Thus, it would appear that neither state
nor church law will support the marriage of three people, even though they are all consenting adults. Statement of Facts This case deals with the practice of polygamy and
the legality of so-called "plural marriage" (The Economist (US), 1988). Debbie Evans, a single woman, wants to marry Aaron Conway, who already has a wife, Barb. The Conways
and Ms. Evans are members of a fundamentalist sect of the Church of Jesus Christ of Latter Days Saints (Mormons); this sect believes in polygamy as a part of their
religious practice. The three have already sued the State of Utah for a marriage license. The suit was filed in Canyon County, Utah, where they live, but they lost
the action when the trial court held that Utahs anti-bigamy law is not unconstitutional. Discussion and Analysis Well turn first to the possible arguments that parties can
