proposition remains controversial and perhaps even unconstitutional. This paper examines the proposition, the politics and the controversy surrounding it. Discussion Prop. 83 is also known as "Jessicas Law," and is
a measure that forces convicted sexual offenders to register; to submit to monitoring with a GPS system for life; and forbids them from living within 2,000 feet of a school
or park, among other restrictions (Goldmacher, 2006). (It should be noted that this paper has 12 sources but they all say virtually the same thing. Apparently the media concentrated on
the same aspects of the Proposition.) While the law may seem like a good idea at first glance, studies of it reveal that it is flawed; further, experiences with a
similar law in Iowa have been disastrous (Miranda, 2006). Americans are prone to flying into hysterical fits when certain "buttons" like "terrorist", "gun control" and "abortion" are pushed. We can
add "sexual offenders" to the list of things that cannot be debated without someone shrieking about the necessity of "keeping our kids safe!" A cynic might point out that as
a nation we care little about our children-if we truly cared, our teachers, not athletes and entertainers, would be the highest paid professionals on the planet-but perhaps thats unfair. Nevertheless,
the point is that this issue cannot be discussed calmly. It is loaded with emotion and those who supported the measure counted on that emotion to carry the Proposition at
the polls, and they were right. Parents have a right to expect that their children will be kept safe from harm when they (the parents) cannot have direct supervision. The
intent behind the law is just that: children will be safe from sexual offenders because those offenders will be registered and monitored. But the idea of Prop. 83 ignores some
