known to participate in. And while the case of Rodney King concluded with a victory for its plaintiff, it did very little to initiate any substantial reform or program to
ensure that police misuse of force would be discontinued in the city of Los Angeles or anywhere else for that matter. Five years later, we are still confronted with
the perennial threat of police excessive force. One might think that Kings was an isolated case, but statistics tell otherwise. In a Gallup poll taken
in March, 1991, the question "Have you ever been physically mistreated or abused by the police?" was asked.iv A most telling statistic was revealed; 5% of all respondents and
9% of non-whites reported having been mistreated or abused by the police.v When asked if the respondents knew of anyone who had been physically mistreated by the police, an
astonishing 20% confirmed such acquaintance.vi Furthermore, several independent studies revealed that approximately 30% of police incidents involving force of any type are perceived by defendants as being excessive.vii
II. Objectives The focal content of this research maintains two inherent objectives. The premier of these will be to examine what definitively constitutes excessive force. This
will include defining excessive force in terms of the courts, police officials, and the citizens view. Defining excessive force in terms of the courts will include looking at different civil
