"excellent way to avoid a potential stiff conviction in favor of an agreed upon lighter conviction" (Plea bargaining). This may seem that plea bargaining would benefit the defendant, because the
plaintiff is giving up the opportunity to press for the maximum legal penalties in order to move the case forward. However, in a plea bargain it seems that the defendant
has a much larger burden to bear than it would in an ordinary case, and that gives the edge to the defendant. At times, plea bargains seem the most logical
course of action. For example, its no secret that America has a severe drug problem, and the "war on drugs" is largely acknowledged to be a failure. Therefore, it might
make more sense to try and rehabilitate users instead of locking them up. In a case like this, a judge might consider dismissing drug charges "in return for the defendants
successful completion of a rehabilitation program" (Plea bargaining). Note that the defendant must successfully complete the program in order for the plea bargain to be effective; if the defendant fails
in his commitment to his rehabilitation, he will find himself facing the jail sentence. When a defense attorney considers a plea bargain, there are several factors that need
to be considered, and the work the defendant has to do is so extensive thats why we argue the process is a greater benefit to the plaintiff. First, a "judge-approved
