the problem of overcrowding in Germany prisons and the solutions that have been proposed thus far. The Federal Republic of Germany is made up of 16 states, each with
its own constitution (Aronowitz). Prisons are categorized as either "open or closed institutions" (Aronowitz). Open institutions are those that have minimal security restrictions and do not have high security walls,
fences or armed guards at their perimeter (Aronowitz). Closed institutions do have high security measures; however, even within closed institutions is not unusual to find low-security areas, especially in
regards to womens prisons (Aronowitz). Prisons are administrated at the state level and, in Germany, there are "neither federal prisons nor private prisons" (Aronowitz). The German Prison Act encompasses the
basic principles of German prison administration, which includes "prisoners positive rights, defines the limitations of prisoners constitutional rights and provides prisoners with recourse to Prison Courts" (Lazarus 4). The
figures for utilization of prisons in all of the German states in the six years prior to December 2000 reveal that there was an increase in excess of more than
one third during this period ("Where is"). While this increase differed in severity between German states, all states experienced an increase: "Saxony-Anhalt, +144%, Saxony, +118%, Brandenburg, +96%, Mechklenbrug-Western Pomerania, +82%,
Hesse, +63%, Berlin, +45%," etc. ("Where is"). In endeavoring to find causes for this increase, Heinz Cornel points out that the most prominent causal factor has been the increase in
youth offenders incarcerated in prisons located in eastern German states ("Where is"). Overcrowding is largely attributed to a "problem of confinement facilities" ("Where is"). This is due to
