of lawsuits that are filed personally against nurses is growing, particularly in regard to those nurses working with critical care, pediatric or obstetrics patients (Chordas 82). Not only can a
nursing supervisor be held responsible for her own actions, but such a supervisor can also be held accountable for the actions of subordinates. For example, a California nursing home
was held liable for 4.5 million dollars in damages and $518,000 in compensatory damages for hiring and retaining a nursing aide without first checking his references, which would have revealed
that the man had a record of prior misconduct (Nabhan 36). In another incident, a nurse was found personally negligent in for placing a steam vaporizer by the bedside of
an elderly female patient (Chordas 82). The patient was badly burned and the nurse was found negligent in her duty to safeguard and protect the client from a foreseeable danger
(Chordas 82). In two large studies, one conducted in Colorado and Utah and the other in New York, it was found that 2.9 percent of all hospitalizations occurring in
Colorado/Utah and 3.7 percent of the hospitalizations occurring in New York resulted incurred adverse events (Dunn 45). Death occurred in 6.6 percent of the cases in Colorado/Utah and in 13.6
percent of the New York events (Dunn 45). In both studies, more than 50 percent of these vents resulted from medical errors that could have been prevented. Extrapolating this result
to include the US, it suggests that 44,000 Americans die each year from medical errors, but some experts feel that this number may be as high as 98,000 (Dunn 45).
