Spilman, as a personal representative of the estate of Walter M. Spilman, the court award a final judgement of $719,064.12 in compensatory damages and $2 million in punitive damages to the estate of the deceased, Walter M. Spilman. Some jurors were so appalled at the treatment that Spilman received that they indicated that they would have gone as high as $10 million in punitive damages (Jury Awards). at the treatment that Spilman received that they indicated that they would have gone as high as $10 million in punitive damages (Jury Awards). Walter Spilman (age 88) was
suffering from Alzheimers disease and senile dementia when he was admitted to the Eastbrooke Health Care Center for rehabilitation services (Sharp). Spilman had previously suffered a fall that caused
a subdural hematoma and had to have surgery to relieve pressure on his brain. He was admitted to Eastbrooke for the express purpose of receiving rehabilitative therapy, which was suppose
to include incontinence training. He was sedated and kept in restraints to such an extend that his skin integrity began to break down (Sharp). Mr. Spilmans condition deteriorated to
the point that he again needed hospital care and his health improved while in the hospital. He was returned to Eastebrooke on April 6, 1990 (Sharp). Between April 6 and
July 18, 1990, Spilman lost roughly 32 pounds, developed bedsores that became necrotic and lost the ability to eat or swallow (Sharp). On July 18, 1990, he was again admitted
to a hospital, where he was intubated so that he could receive nutrition. He was again returned to Eastbrooke3 on July 23, 1990, where he continued to decline. He was
readmitted to the hospital again on October 3, 1990 and died on October 15, 1990 (Sharp). The list of indignities and poor care that Spilman suffered is truly astounding.
Besides being restrained for hours at a time, Spilman was often left sitting tied to a geri-chair in soiled clothing (Sharp). When the feeding tube was inserted, nurses testified that,
