officials when the New Haven Civil Service Board (CSB) made the decision not to certify exams needed for the plaintiffs promotion with the fire department due to the fact that
this would have promoted "a disproportionate number of white candidates in comparison to minority candidates" ("The Oyez Project," 2009). The question before the Supreme Court was whether or not a
municipality can "reject results from an otherwise valid civil service exam when the results unintentionally prevent the promotion of minority candidates?" ("The Oyez Project," 2009). The following examination of
literature considers the question as to whether or not the city of New Haven acted reasonably in rejecting the test results based on the lack of minority representation with the
fire department? In a 5-to-4 split decision, the Court rules that the Civil Rights, under Title VII of the Civil Rights Act
of 1964 were violated; however, four justices dissented, arguing that the City of New Haven did have reasonable cause to believe that it would be "vulnerable to a Title VII
lawsuit if it certified the exams" ("The Oyez Project," 2009). The Supreme Courts ruling stated that "fear of litigation alone cannot justify an employers reliance on race to the detriment
of individual who passed the examination and qualified for promotions" (Mereau, 2009). Epstein (2009) points out that the city of New Haven had gone to "great lengths" would provide
a fair evaluation of candidates for promotion to the rank of lieutenant and captain within the fire department. However, this was to no avail, as African American and Hispanic candidates
