Compiled by P. Giltman 7/2010 Please Sovereign immunity is a concept that the state or
government can do no wrong. In other words, the presiding body of government cannot be held legally accountable for anything it does and is therefore immune from any sort of
prosecution. The saying, "The King can do no wrong" is an idiom for sovereign immunity. However, in an effort to reduce the amount of damage a government entity could do
without being held liable, the United States Congress passed the Federal Tort Claims Act in 1946. In the bill, the government basically gave permission to be sued in federal court.
Therefore, a federal district court judge would be required to sit without a jury and pass judgment in these cases. Congress passed the law to ensure the federal government did
not abuse its power. However, there are still several exceptions in which the federal government retains sovereign immunity. Some of these include enforcing unconstitutional statutes, losing letters in the post
office, actions of the military in time of war, damages caused by the fiscal operations of the Treasury Department or regulation of the monetary system, collecting custom duties, claims arising
in a foreign country, and most intentional torts. In addition, it provides full compensation to persons injured by commonplace negligence of government employees. Each state has its own tort claims
