Water rights for Native American tribes are as essential as any of the other provisions allowed for in their treaties with the U.S. government. Although water
rights are not always mentioned in historic treaties, the Supreme Court ruled in 1908 in Winters Verses United States that:
"in establishing reservations, Congress implied and reserved the priority water rights necessary for present and future use" (Lewis, 2001, PG).
It could be contended, that water rights are of even more importance than some treaty provisions given the location
of most Native American reservations in the arid West (Lewis, 2001). Water in these areas is a highly coveted resource, one which sustains life itself. It is also
a resource which has suffered considerably in the face of modern development practices. Among the development projects which have directly impacted Native American water rights most dramatically are dams.
