because he believed this scenario fell under a "road service" situation. When the truck got back to the station, it was noted to have some minor damage to a mud
flap and light. The company eventually fired him claiming Gregory failed to file an accident report when damage was done to the vehicle and he should have never used the
truck for personal reasons. For background purposes, it should also be noted that Gregory, under the unions auspices, was elected chairperson of a newly formed committee that represented the employees.
This committee allowed him to discuss any issues with management such as compensation levels, policies, procedures, safety concerns, etc. His election undoubtedly raised some eye brows among management and his
termination occurred less than two weeks later. In support of the terminated employee, the union argues that Gregorys firing had nothing to do with the accident or taking the
truck for personal reasons to visit his brother in prison. Rather, they believe he was fired for violating the National Labor Relations Act by engaging in solicitation of union bargaining
authorization cards. In addition, the company claims Gregory failed to file an accident report after damaging the truck and also using the truck for personal purposes. The union contends that
Gregory received permission from his supervisor, Terry, to use the truck to visit his brother and he followed all company policies by contacting road side service rather than filing an
