equality it had in mind was to create equal health by biasing the treatment of men and women to address a physical inequality that women were seen to suffer from.
The case was clear in the way it saw men and women, one sex was not seen as inferior to the other, only different. It is ironic that a court
case which was designed to protect women, which was not fought on the grounds of gender or discrimination, was to have a negative impact for many years as women sought
to fight for equality with men. The idea of equality was an idea that was increasing in popularity, for the womens movement the idea was one of equal status
and equal rights under the law. It was at the time of this case there was a growing suffragette movement calling for the right of women to vote. Equal pay
and conditions may also have been prominent. However, this was not the way equality was presented to the court. Indeed equality was not the way that this case was fought.
The case was brought by Muller a laundry owner who used the labour of women. However, in Oregon there had been a law passed in 1905 that prevented the women
working for more than ten hours a day. Muller argued that this was unconstitutional, as it prevented women the freedom to form whatever contracts they anted to form. In an
earlier case, that of Lochner v. New York (1905) there had been a similar action. This action had been in a bakers with mostly male workers. In this case the
action was brought that under the fourteenth amendment it was unfair to restrict the hours the men work, this argument own and the restriction was lifted. The Muller case appeared
