force riders to don their helmets whenever hitting the road. Other states leave the decision up to riders or only have laws directed at younger riders often minors or anyone under the age of twenty. This section of the paper helps the student to present a straightforward overview of the legal issues surrounding motorcycle helmet use. The federal government first enacted mandatory helmet laws in the late 1960s (Derrick & Faucher, 2009). States were enticed to adopt the law with the promise of federal funds and soon most states enforced helmet laws. In order to bring the other states on board, the government began to force fines on those states that failed to enforce the law. Two decades later and the federal government loosened penalties and states began to repeal helmet laws. Currently only three states have no mandatory helmet laws with twenty states requiring helmets for all riders (Homer, 2009). Advocates supporting helmet laws state that they save lives and reduce injuries sustained in crashes. The national Transportation Safety Board estimate that 12 motorcyclists die each day in motorcycle crashes with the majority of those deaths being attributed to head injuries. The argument over helmet laws does not concern whether or not helmets save lives, however. Rather, the argument involves the case of civil liberties and if it is right for the federal or state government to enforce such laws on riders. The main issue many motorcyclists have with helmets laws is that it is a law in the first place.
