precision the characteristics that justify classifying human behavior as criminal, and then to scale crimes proportionately in relation to one another. Moral Philosophy considers the fundamental principles that
govern legal decision making, plus both practically oriented and morally oriented forms of reasoning. Jurisprudence The relationship between criminal law and jurisprudence is one of complex interplay,
consequently it is necessary to examine the ways the values and practical rules of jurisprudence (the general principles of law) and the values and practical precepts of the criminal law
(the particular principles of each case adjudication) inform each other. Due Process involves carrying out of individual legal rights guaranteed by the Constitution, which include: Right to speedy
and public trial. Right to confront, examine and present evidence. Right to testify, and not to be compelled to testify. As well as the right to the
assistance of counsel. Plus the right to subpoena power of the court. The right to force state to prove its case. Freedom from double jeopardy. And
the right to be treated the same as others Conclusion Although we know that the US Constitution guarantees certain rights to its citizens, it seems as though there are
times when criminal justice, which is concerned with the application and administration of criminal law, and social justice which is concerned with moral right and societal standards, are in conflict.
