According to Rogers (2007) moral retributivism is distinct from retributivism. In the latter, the infliction of suffering on those that do wrong is
regarded as just. This view isnt something that has found widespread support in recent decades, however. Never-the-less, Rogers (2007) purports the merit of what she refers to as
"impure" or "mixed" moral retributivism. Under this "impure" approach bad character justifies suffering but there is a key distinction. That distinction is that while suffering is justified by
the bad character, it is not the responsibility of the state to insure that suffering occurs via legal punishment. This paper will argue just the opposite. It is
not only the responsibility of the state to punish criminals, it is one of the primary functions of government. Rogers
(2007) insists that when a person repents of their past behavior that should be taken into account before inflicting punishment. In other words, repentance should be rewarded with
less punishment. This paper, however, will argue that point and insist that crime should be punished consistently and predictably if we are to ever reclaim our society. To
do otherwise simply introduces too many variables. Rogers (2007) argument that repentence is justification for reduced punishment, very simply, is poorly thought out.
