Economist states that US Airways is emerging as the example company of all that is wrong with the airline industry in the US. "Mismanaged, mired in debt and crippled
by a recalcitrant workforce" (Enough already, 2004; p. 15), US Airways September 2004 filing for Chapter 11 protection was the airlines second foray into bankruptcy in two years. This
is despite (or perhaps because of) the governments $1 billion loan guarantee made as part of the bailout of the airline industry following 9-11.
The author of the article muses that it may be time for the bankruptcy courts judge to depart from the normal course of action when an airline files Chapter
11, which is to grant protection so that the airline can remain operational as it restructures. It may be time to "permit economic reality to prevail by letting US
Airways go into liquidation" (Enough already, 2004; p. 15). This would be a difficult decision, to be sure. But it may well
be time for an airline to be sacrificed as an example to all of the others currently operating under the protection of Chapter 11. It should be clear to
airlines senior management that the industry needs more than only the temporary fixes that Chapter 11 offers. We have come to the point that the poorly managed airlines are
rewarded for their poor performance while venerable, profitable Southwest and other well-managed airlines are forced to compete against increasing numbers of "protected" competitors. 2. Identify one hostile takeover attempt of a
