Notorious for its anti-union management policies, Wal-Mart has increasingly drawn criticism for practices that have been ruled unjust by the courts, such as locking employees in after closing hours until inventory is completed or not paying employees for mandatory overtime. Wal-Marts latest legal troubles involve the largest class-action suit in US legal history. This suit involves 1.6 million current and former female Wal-Mart employees who allege that Wal-Mart systematically imposed managerial policies that discriminated against women. Facts of the case and its ethical dilemma More than 72 percent of Wal-Mart employees are female, yet women hold less than one-third of management (Luce 54). Furthermore, research data from 2001 shows that the average male working for Wal-Mart is paid $5000 more per year than the average female full-time employee (Luce 54). Even within the job descriptions that are largely dominated by women, such as cashier, men earned more than women on average (Luce 54). In other words, in cases within the company where men and women do identical work, at the same performance level, men generally make more than women. The stories that the women in the suit relate relative to their work experience at Wal-Mart are all remarkably similar. They were promised the chance for advancement, yet despite hard-work and good performance ratings, were always passed over for promotion. Rationalizations for this have often been remarkably flimsy. For example, when one woman, Cleo Page, was passed over for promotion, she was told that she should wear "shirts with collars" (Luce 54).
