things. But does this particular act ban discrimination on the basis of . . . accents? This seems a little strange. After all, if someone is having trouble communicating with
someone else because of heavily accented English, it would make sense that perhaps that person isnt in a good position to receive a particular job or promotion. But this is
not necessarily how the Equal Employment Opportunity Commission (EEOC) sees this. Lets take the case of Maria, who is of Latino ancestry.
Maria filed a complaint with the EEOC that she was eliminated for consideration for a promotion because of her distinctive accent. How did Maria come to this conclusion?
1) Alex, who did receive the promotion, is a Caucasian male with a graduate degree (like Maria has). But Alex hasnt been at the company
as long as Maria has. Alex tends to have better evaluation marks, however. But Maria believes her lower marks are because she is the only person of color and the
only woman in her department - and the poor marks are a built-in bias on the part of her white, male supervisors. 2)
Maria says she was gold by her supervisor she was not being promoted because he feared the clients would have trouble understanding her, because of her accent.
3) Maria says her tardiness and absences have been due to family problems. Meanwhile, the companys contention is that
