1996). Although this figure reflects less than one percent error, this is a something the nation can ill afford when dealing with human life. Journalist Abraham Abramovsky (1996) writes that
he has always opposed the death penalty, primarily because executions "have no place in a civilized society" (A35). Much of the constitutional debate surrounding the death penalty concerns this same
premise -- the death penalty is incompatible with the Eighth Amendments prohibition against the imposition of cruel and unusual punishment. Justice William Brennan, Jr., has argued that the a death
sentence is not only offensive to the dignity of the prisoner, but also to the evolving standards of decency which reflect the advance of a maturing society (Murphy, 1993). The
