Legislation, such as the Nursing Practice Act of individual states, as well as the rules implemented by state nursing boards, establish the parameters that guide proper implementation of nursing delegation in order to ensure patient safety. The following examination of nursing delegation focuses on the nursing laws and regulations enforced within the State of New Jersey. Two cases of improper nursing delegation are examined within this legal framework. New Jersey and nursing delegation For over a decade, the New Jersey Board of Nursing has focused on the issue of nursing delegation (Reinhard, 2010). The New Jersey Nurse Delegation Pilot project seeks to educate both nurses and UAP concerning the tasks that can be safely delegated (Reinhard, 2010). New Jersey Board of Nursing Laws provide definitions for each category of practitioner and this includes specifying that a homemaker-home health aid is an employee of a home care service agency who is delegated to perform certain nursing tasks that have been authorized by a licensed RN (NJ Board of Nursing Laws, 2011). New Jersey law further defines UAPs while emphasizing that the supervision of and delegation of nursing tasks should occur and be determined by licensed RNs (NJ Board of Nursing Laws, 2011). New Jersey law stipulates that an RN is allowed to delegate specific nursing tasks individuals who are unlicensed if they have been adequately educated to conduct these tasks safely via verifiable training and instruction and have demonstrated competency at these tasks (Reinhard, 2010). Furthermore, there is a long list of nursing tasks for which no specific training is required.
