cop went to Spikes motorcycle shop and was given permission for a limited search for burglar tools belonging to an employee, Mac. In the course of that search he found
the burglar tools but also saw and confiscated drugs: marijuana was lying in the open and cocaine was concealed. He found the coke after a full search of the shop.
Can Spike be charged with possession of cocaine? This could go either way; it depends on how the court views probable cause. The
officer inferred that because there was marijuana present, there were other drugs as well, which could be considered a reasonable assumption. However, there is no direct link between Spike and
the coke (it could have been put there by Miscreant Mac without Spikes knowledge) so its probably not admissible. The burglar tools are
admissible. They were found in a locker belonging to Mac and Mac is the suspect for whom the cop is looking. That is, he came to the shop with probably
cause that Mac was guilty. The marijuana is also admissible, because it was lying on a table in full view of anyone who came into the shop, which gives the
officer tacit permission to seize it. Since Spike owns the place, hes responsible for the marijuana. Question 2: International jurisdiction: What court has jurisdiction over defective products manufactured in another
