protected by the Commerce Clause. The Commerce Clause is found in the US Constitution (Article I, Section 8, Clause 3) which regulates
commerce between states, foreign powers, and Indian Tribes ("Commerce", 2011). It was the first instance of legislation directed to providing uniformity in commerce between different states. The Commerce Clause has
been used in cases that do not necessarily have anything to do with commercial or interstate trading ("Commerce", 2011). For this reason the Commerce Clause has been the source of
controversy since many believe that it allows the Federal Government too much authority in State affairs. With the ever evolving and changing face of commerce and products new laws and
legislation has been developed with a similar agenda of the Commerce Clause. The Uniform Commercial Code was designed to further the powers and
protection of the Commerce Clause. It attempts to further the goal of harmonizing state to state commercial sales and sets forth various rules and regulations to govern such sales. Seeing
the need to regulate sales across state lines, the UCC was designed to create a uniformed code of commerce. This law covered only personal property however and not intellectual property.
The UCITA was, originally, supposed to be a part of the Uniform Commercial Code. Instead, it was modified into its own proposal. While the UCC deals with a variety of
goods, the UCITA is only concerned with computer information hence the full name Uniform Computer Information Transactions Act. The chief difference between the UCC and the UCITA is that Article
2 of the UCC deals primarily in the sales of goods while the UCITA was designed to focus on the licensing of property such as software, programs, and others items
