of 2005 to remove the life-sustaining treatment from his wife, with an effective date of April 8, 2005. In the petition, Herb argued that his wife never wanted to
be kept alive artificially, and that his desire to remove the feeding tube was the result of his desire to do what Debra would have wanted. Debra
left no directive for care in this type of case, and did not make her wishes expressly known to her parents. In the State of Nevada, Debras next-of-kin, her
husband, has the priority to choose life or death for Debra. Under NRS 449.810, the Court can designate a power of attorney in medical decision-making for Debra, and the
status of the power of attorney most commonly goes to the next of kin. Because of Debras marital status at the time of the accident, and because there was
no immediate challenge to her husbands seeking power of attorney over her medical decision-making, the Court granted Herb Thomas the right to make these decisions for Debra. In Debras case,
the use of a feeding tube is not considered extraordinary medical care, but is considered life-sustaining medical care. Under Nevada Statute NRS 449.570 life-sustaining treatment is defined as
any "medical procedure or intervention that, when administered to the patient, serves only to prolong the process of dying" (Added to NRS by 1977, 759; A 1991, 633). In
Debras case, physicians have determined that her brain damage is irreversible and that her condition will not improve. Though Debra needs no other life sustaining treatments other than the
