In continuation of a previous paper, this paper will address the legal issues involved in establishing a home-based child day care business in Texas. Most of the paper will be devoted to state regulations, particularly since Texas has introduced far-reaching changes to its home-based child care regulations that will become effective January 1, 2007. Next the paper will discuss local laws, which generally are limited to zoning issues and local requirements that the owner maintain a business license. Finally, the paper will discuss the need for insurance. This is not a legal matter in that businesses are not required to maintain insurance, but those deciding against it are assuming huge risks that could cost them everything should an accident occur. State Regulations Currently and through December 31, 2006 the state regulations for home child care are provided by and through the list of documents provided in Table 1. The first entry, Chapter 42, is the section of the Texas general code addressing day care operations and includes day care centers as well as home-based day care businesses. All other documents arise from or expand on items contained in Chapter 42, which is specific in very few items. It is left to regulatory agencies such as the DFPS to interpret the law, write regulations that are in accordance with the law and then enforce the regulations it has formulated based on the law as it exists at the time.
