Of course the law is not enforced or even acknowledged, but it does serve as example of the need for laws to evolve as technology changes. Telecommunications laws are not quite as antiquated, but they too are obliged to change and evolve along with technology. The purpose here is to assess some of the ways that telecommunications law is influenced by technology. Calls for Reform House Energy and Commerce Committee chairman Rep. Joe Barton (R-Texas) echoes the thinking of many who are involved in some area of the telecommunications industry. The Congressman says that existing telecommunications law needs a total overhaul. Congressman Barton says that "Internet technology and broadband distribution require an entirely new regulatory model" (Hearn, 2005a; p. 12). The reason for this thinking is that broadband has refused to fit into any existing regulatory categories, and that it may be more sensible to start over on telecommunications law than to try to revamp what currently exists (Hearn, 2005a). What currently exists resulted from a similar overhaul in 1996 as the Internet began to come into its own (Hearn, 2005a). One of the factors leading to this position is that so much of the telecommunications industry is no longer self-contained as it was in the past and as current law is written, particularly as convergence in voice, data and video continues to progress (Hearn, 2005a). As these aspects of telecommunications advance technologically, increasingly both competitors and regulators are hindered by existing laws that generally address only cable and telephone companies, and force emerging technologies ...
