Legal issues The Education of All Handicapped Children Act of 1975 stipulates that each state and local educational agency must provide every child receiving special education with an Individualized Education Program (IEP) (Gallagher and Desimone, 1995). Furthermore, this law, as well as subsequent regulations, states that the IEP must be developed by an interdisciplinary team and include the following factors: 1. A statement of the childs present level of educational performance; 2. Annual goals and instructional objectives; 3. Statement of specific education services to be provided to the child; 4. A statement of the extent to which the child can participate in regular education programs; 5. The projected date and anticipated duration of the services; 6. Objective evaluation criteria and evaluation procedures; and 7. A schedule for annual review of the childs program (Gallagher and Desimone, 1995, p. 353). Parental participation in the IEP development process is also mandated, as it is believed that this will increase parental involvement in their childs program (Gallagher and Desimone, 1995). In 1986, the US Congress created legislation that recognizes that many infants and toddlers suffer from developmental delays and disabilities, and require services from a variety of individuals and agencies, both public and private, in order to reach their full potential (Harbin, et al, 2004). The current incarnation of this legislation is the Individuals with Disabilities Education Act (IDEA) of 1997. Included in this legislation are stipulations that are designed to facilitate coordination of services to at-risk children (Harbin, et al, 2004). A requirement of this legislation is the requirement that an Individual Family Service Plan (IFSP) should be created for the families of at-risk children, which can be used as a guide for service delivery for each eligible child (Harbin, et al, ...
