Though founder Kathy Kudler has been a whiz at building her franchise, there are some holes in her system. One of those
holes involves her legal department. The "department" in question is actually a sister-in-law who is a tax attorney. Kudler talks to this attorney by telephone and at family gatherings -
and accept for slip-and-fall accidents, there really is no legal policy in place for much of anything else. As qualified a tax attorney as Kudlers sister-in-law may be, there is
a vast difference between dealing with legal issues pertaining taxes and legal issues pertaining to complaints that people might be getting sick from products that Kudler Fine Foods is selling.
This wouldnt be much of a problem if Kudler wasnt involved in food. Not just food, but food that is fresh - especially
produce. In 2006, the United States went on a fresh spinach cleansing phase as certain packages of fresh spinach were found to have E.coli, a bacteria known for causing digestive
issues such as vomiting, diarrhea and dehydration; and in some cases, death. The 2006 outbreak was traced to spinach grown in California and it caused multiple hospitalizations, at least one
death - and many lawsuits (Won Tessoriero and Lattman, 2006). How would this type of thing impact Kudler Fine Foods? If some
of that tainted spinach had found its way into Kudlers produce department, someone might have thought to sue the store for negligence. This may not seem fair, but given the
litigious society in which Kudler operates, this company needs to be prepared for any contingency. In fact, its amazing that Kathy Kudler herself hasnt thought of this - shes very
