Our criminal justice system has been established to determine the guilt or innocence of those accused of a crime and to punish those that are
found guilty. Some contend, however, that our criminal justice system does not always dispense justice! Furthermore, these critics of the criminal justice system contend, incarceration is not an
effective way or rehabilitating offenders. As an example of the injustices that we perceive in our criminal justice system consider allegations
that our criminal justice system is racist or, more specifically, that blacks are arrested and convicted more often and with harsher sentencing than are whites. If true, this certainly
supports the contention that justice is not always dispensed in the courtroom. Statistics do reveal that blacks are more likely to
be arrested, prosecuted and imprisoned than are whites and even other minorities. Although blacks represent only 13 percent of our national population they represent some 37.5 percent of those
imprisoned in state and federal prisons (MacDonald, 2008). One out of every 33 black men was imprisoned in 2006 (MacDonald, 2008)! This compares to only one in 79 Hispanic
men and one in 205 white men (MacDonald, 2008). Before charging on with accusations that an injustice has been committed, however, we must examine the facts more closely.
