The factors that affect the outcome of a trial by jury are varied to say
the least. Many of these factors rest with the idiosyncrasies of the jury itself. Others rest with the state rules that are in place, rules that can vary
significantly in terms of just what is required to reach a final verdict or decision. So-called "decision rules" determine such details as whether a unanimous vote is needed to
levy a verdict or whether only a ten to two or even a nine to three vote is needed. The jury personality interblends with such factors to yield a
distinct deliberative process and outcome for each case that finds itself being tried by jury. Decision rules might be contended to be one
of the most influential impacts on the jury deliberative process. The contrast that exists between various states in regard to the deliberative process and the verdicts that can be
rendered is no better illustrated than by a quick look at cases involving violent crimes and, in particular, murder. For felony trials in every state except Louisiana and Oregon
a unanimous jury is required to convict a defendant. This requirement cannot help but interblend with other decision rules to greatly impact the deliberative process.
Some states require that when jurys levy a guilty verdict in a murder case the defendant is automatically are sentenced to death. Although the legitimacy of
the death penalty has been tested time and time again, some jurors continue to regard the death penalty as inhumane or at the very least as cruel and unusual punishment.
