it was alleged that the administration of President George W. Bush approved, and backed the firings. The situation became even more of a tinderbox because the Justice Department and the
U.S. Attorney General (who was Alberto Gonzalez, a good friend of Bushs) were supposed to be immune to political partisanship. Congressional hearings took place on the matter, and the scenario
ended with Gonzalezs eventual resignation and the reinstatement of a handful of the attorney generals. Do US Attorneys have statutory protection from the Merit Systems Protection Board against dismissal?
This depends. According to the Merit System Principles as outlined in the Merit Boards "An Introduction to the Merit Systems Protection Board, "retention
should be based on performance, inadequate performance should be corrected and employees who cannot or will not improve their performance to meet required standards should be separated" (1999). Furthermore, "employees
should be protected against partisan politics and may not use their offices for partisan political purposes" (1999). There are other statements in terms of merit systems that refer to discrimination
that has nothing to do with the "performance of an employee," meaning that a government employee cant be fired for political beliefs. If he/she isnt doing the job well, this
is another matter. The Merit Systems Protection Board has a whole list of reasons for dismissal; and not performing on the job is one of them. But the Board also
points out there are various procedures that the employer (i.e., the government) needs to follow before firing an employee. As well see in the next section, this includes written notification
(so the employee can respond or improve). In short, the employee needs to know that a possible termination is coming. As far as can be told, this wasnt the case
