Dual relationships present some of the most challenging circumstances in regard to confidentiality. Working with couples or other related individuals such as a parent and a child, for example, puts the counselor in a particularly precarious situation. (Cottone, 2005). So too could a precarious situation arise when working with court-ordered clients. In the face of a court order a counselor would be required to release information from the counseling session as well. An obvious conflict of interest could arise in the situations outlined above. Consequently, the Code of Ethics of the American Mental Health Counselors Association specifies that one of these clients be designated as a client and the role of the counselor modified accordingly (Cottone, 2005). The Code of Ethics of the American Mental Health Counselors Association also requires that when counselors are put into a position where their interests may conflict that they attempt to clarify that situation and either adjust it accordingly or simply withdraw from the counseling role with one or more of the clients (Cottone, 2005). This particular charge is one of the more difficult in the counseling profession (Cottone, 2005). There are numerous situations where a counselor will find it necessary to interact with family members and other individuals that are significant to a client on a certain frequency (Cottone, 2005). The counselor is bound by ethical code, except in very specific situations, to keep information obtained in a counseling session confidential.
