This research, first of all, relates the process for finding a replacement for these Supreme Court positions and then discussing the possible ramifications of this situation, and then closes
by addressing another compelling issue, the status of the capital punishment debate. The powers and structure of the United States Supreme Court are detailed in the first and second
sections of Article Three of the US Constitution. There are nine justices and the Constitution also stipulates that their appointments are for life. While there are no compulsions for a
justice to step down, most of them usually retire at some point. When this occurs, leaving a vacancy, the President appoints a nominee, but this nominee has to be confirmed
by a majority vote of Congress in order to assume office. One of the nine justices is designated the Chief Justice and the rest are referred to as Associate Justices.
It as anticipated that Chief Justice William Rehnquist would announce his retirement, due to ill health, at the close of this Supreme Court session, which occurred June 27. He
is currently expected to announce his retirement some time this summer (United States: Rehnquists legacy, 2005). Also, there is a rumor circulating that Justice Sandra Day OConnor may retire for
family reasons (United States: Rehnquists legacy, 2005). If either of these justices retire, the country, President George W. Bush and Congress are in for a long, hard struggle over approval
of nominees presented to Congress by the executive branch. This is because many of the Supreme Courts most significant decisions, in recent years, have been made by the narrowest
of margins, that is, five to four votes have not been unusual. One more conservative justice on the Court and liberals fear that lines divided church and state wold begin
