the CBP. Discussion The Bureau of Customs and Border Protection (CBP) is "the unified border agency within the Department of Homeland Security (DHS). CBP combined the inspectional workforces and broad
border authorities of U.S. Customs, U.S. Immigration, Animal and Plant Health Inspection Service and the entire U.S. Border Patrol" ("Protecting Our Borders Against Terrorism"). The CBP employs more that 41,000
people who work to "manage, control and protect" the borders, both at and near the ports of entry ("Protecting Our Borders Against Terrorism"). Members of the CBP regard themselves as
the first line of defense for the United States ("Protecting Our Borders Against Terrorism"). As it happens, the CBP has what it calls "Twin Goals": currently, their two most important
priorities are to prevent terrorists and their weapons from entering the U.S., and at the same time, facilitating the "flow of legitimate trade and travel" ("Protecting Our Borders Against Terrorism").
We can see some of the complexities of this task in a Notice that appeared in the Federal Register in December 2006. The notice updates a July 9, 2004 Notice
which in turn discussed a May 11, 2004 document; the May document contained "representations regarding the manner in which CBP would handle certain Passenger Name Record (PNR) data relating to
flights between the United States and European Union (EU) member states" (Baker). When it was first issued, the May Notice provided the foundation "for the European Community (EC) to enter
