police administrator on a continual basis. Insuring that police interactions with the public are as optimal as possible is at the center of many of these issues. The police administrator often relies not only on internal policy but on court rulings that define what is appropriate and what is not in regard to police interactions with the public. Even then, however, there are sometimes inconsistencies in what seems appropriate and what does not. The police administrator must, therefore, be vigilant in monitoring court decisions and interpreting policy accordingly. This is particularly complex in a multicultural environment. Kinports (2007) observes the inconsistencies in Supreme Court decisions regarding even key issues like search and seizure and confession validity. He contends the Court has shifted "opportunistically from case to case between subjective and objective tests, and between whose point of view--the police officers or the defendants--it views as controlling" (Kinports, 2007 p. 71). Kinports (2007) asserts that the Court has even wavered back and forth in regard to details involving such cornerstone decisions such as Miranda, the procedural safeguard requiring that a suspect be informed that he or she has the "right to remain silent unless he chooses to speak in the unfettered exercise of his own will" (384 U.S. 437). Miranda, of course, is a key element in police procedure. It insures the Fifth Amendment privilege against self incrimination. According to Kinports (2007), however, the Supreme Court has not been consistent in terms of who should be Mirandized and under what circumstances.
