and there have long been those who argue "an eye for an eye" in terms of executing people who have committed horrendous crimes. Putting the controversy aside, however, one must
perhaps ask is the death penalty administered fairly? The following paper argues that it is not administered fairly. Is the Death Penalty Administered Fairly? There are perhaps many
people who would argue that the death penalty is administered fairly because it only comes into play with the most horrendous of crimes and those crimes are specific, such as
murder. But, there are so many different variables involved in the crimes that to truly be fair is impossible. For example, a man, desperate to feed his family, who breaks
into someones home with the intention of robbing them finds himself face to face with someone in the house and he shoots out of fear. It is his first offense
yet he could be sentenced to death. Another man breaks into a house and actively seeks out a member of the house to shoot and kill. He is a hardened
criminal and he also is sentenced to death. Now neither of these men would likely end up being executed but the law allows that they could be executed for the
same crime, although clearly the crimes and criminals were different. This is not necessarily fair. When one looks into the truth about fairness one can well see many arguing
it is very fair and others arguing it is not fair. Most of these people are perhaps common citizens. In the following, however, the words of a judge, a man
who has been a judge for over 20 years, illustrate first hand experience with the fairness of the death penalty: "I have seen many death penalty cases and I have
