In theory, when a crime is committed in the US and a criminal is
tried and found guilty of that crime they are subject to the same sentencing that any other criminal would be subject to given similar crimes. Although there are certain
complexities in the sentencing phase that are worthy of note, the assumption is that a criminals race would have no impact whatsoever on his or her sentence. Contentions abound,
however, that our criminal justice system is racist or, more specifically, that blacks are arrested and convicted more often and with harsher sentencing than are whites. The intent of
this paper is to more fully explore that contention. Racism in the criminal justice system, if it does indeed exist, would certainly be a
blight on a nation that from its inception has prided itself on "equality for all". Contentions abound, however, that is indeed the case. Statistics do reveal, in fact,
that blacks are more likely to be arrested, prosecuted and imprisoned than are whites and even other minorities. An astounding eleven percent of black males aged 20 to 34
are either in prison or jail (MacDonald, 2008). Although blacks represent only 13 percent of our national population they represent some 37.5 percent of those imprisoned in state and
