the candidates, including President Obama, stated that health care is a fundamental right for all Americans (Olson, 2009). He even went so far as to say he was going to
guarantee that every American would have access to good health care services. But, he also said that every American would be able to purchase health care services (Olson, 2009). There
is an inherent contradiction there but thats nothing unusual for politicians. We will all agree that purchasing health care is not the same as a federal government providing health care
to all citizens. So, it comes down to only one conclusion - all Americans will have the right to purchase health care programs but we already have that right so
nothing changes. Haft (2003) reminds the reader that there is nothing in the Constitution of the United States that says anything about health care services for citizens. This is interesting
because the Constitution does state that all Americans "are endowed with unalienable rights, among them are Life, Liberty and the pursuit of Happiness" (Haft, 2003). If we have very poor
health because we cannot afford to receive the appropriate medical services, our life will soon be snuffed out. If our health is poor, such as having a chronic disease with
pain, our pursuit of happiness is certainly limited. In effect, we are deprived of the most fundamental of all fundamental rights endowed to Americans. There is another issue in
the Constitution that could be brought into play in this debate. The 8th Amendment addresses "cruel and unusual punishment" which we typically apply to criminals (Haft, 2003). However, courts have
found that denying proper and timely health care services, i.e., medical services to prisoners constitutes cruel and unusual punishment" (Haft, 2003). Would that apply to the general citizenry? Would the
