It was as a result of the asymmetry of power at the beginning of the twentieth century that the unions rose to power, seeking to redress the power and serve the interests of their members (Laybourne, 1992). Times have changed and the development of the EU has seen increasing levels of regulation exercised over the employment relationship with social consideration of equity and balance in the employment relationship. It appears logical that were decisions are made by employers that may have a long term impact on the employees that the employees would be consulted on these issues. It is this value that is the underlying principle of Directive 2002/14/EC, which established a framework under which employees will have the right to be informed and consulted on certain issues. The directive lays down minimum standards in terms of the employees rights. With the development of a directive that is to be implemented across all EU countries it may be argued that this is a suitable framework to be expanded and used as a basis for international standards. There is support for the need to implement an employee consulting framework, in line with the OECD social labour policies (Seifert, 2008). It is argued that there is the need to strengthen the agreements which are already in place by agreement or union negotiation (Seifert, 2008). However, it needs to be considered whether or not the directive is suitable as the bias for international implementation outside of the EU as well as within it.
