A common problem is that landlords will deduct moneys from security deposits when people move out, something done to compensate for damage. However, what a landlord sees as ordinary wear and tear can be quite different from what the tenant believes. All sorts of disagreements will arise when either a tenant moves out, or is still in residence. Some disagreements that might crop up when a tenant is still in the apartment could be regarding noise, damage to the residence and so forth. Tenant complaints, on the other hand, might involve disputes where the landlord has not fixed something as promised. Rent strikes sometimes will occur when a group of tenants are not given proper heat, hot water or other fundamentals. However, disputes are present when either party does not agree to the original terms of a lease. Barham v. Davenport is a case that involves the failure for the landlord to allow the renter to purchase the property, an option that was clearly stated in the leasei . Although that is the case, in the end, it was noted that the tenant did not comply with the original terms of the contract in that he was expected to notify the landlord that he had an intent to purchase prior to June 1, 1953 and he did not; the outcome of the case was that the landlord was not obligated to give him the option to purchase and the end of the case was ordered as follows: "The complaint shows upon its face that the plaintiff failed to give notice of his election to exercise the option within the time limited.
